On the streets of post-war Berlin, a Holocaust survivor traded a gold plate for a pack of cigarettes. It later turned out to be a rare artefact from a museum worth £6.6 million. But the woman's family can keep the item.

The Archaeological Museum in Berlin demanded that the 3,200-year-old Assyrian artefact be returned by the Riven Falemnbaum family because it was originally stolen by Soviet troops. That literally looted the museum.

The family acquired the rare object thanks to a relative who traded the gold plate for cigarettes on the streets of post-war Berlin. But the museum logically tried to get the artefact back because it was the original owner.

In the end, the court had to decide, and it sided with the Polish family. They can keep the golden artifact, even though the museum was looted by the Soviet army and the artifact was taken away. So the family doesn't have to hand over the gold plate anywhere.

Soviet troops looted the museum's warehouse in 1945. Then the soldiers traded it for a few packs of cigarettes. The plate was originally found in 1913 in the ruins of an Iraqi temple by German archaeologist Walter Andrae. It was then sent to Germany, where it was put on display at the Archaeological Museum in Berlin.

According to Judge John Riordan, the museum waited too long to stake its claim to the artifact. If they had done so sooner, they had a chance of the plate returning to the collection of the museum, which has one of the largest collections of Southwest Asian art in the world. Fourteen rooms spread over 2,000 square metres of exhibition space depict Southwest Asian culture spanning six millennia.

That's why a Polish family can keep it. Their lawyer, John Farinacci, said they had no idea what the plaque was worth. They thought it was about a hundred dollars. They never had it appraised by an expert. In fact, the family never even thought of it.

The attorney also said the family has no plans to sell the plate. "It was part of the story of their relative who carried this precious item," the attorney added.
